TERMS AND CONDITIONS

The general terms and conditions of the online KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop, have been drafted in line with the Consumer Protection Act (ZVPot), Personal Data Protection Act (ZVOP-1), and the Electronic Communications Act (ZEKom-1). The online KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop (hereinafter also “Shop”), is managed by the company PIŠEK - Vitli KRPAN d.o.o., Jazbina 9a, 3240 Šmarje pri Jelšah, which is also the provider of e-commerce services (hereinafter also “Seller”).

The general terms and conditions define the performance of the online shop, www.vitli-krpan.com/en/fan-shop, the rights and obligations of the User (Buyer) and store (Seller), and govern the business relationship between PIŠEK - Vitli KRPAN d.o.o. and the Buyer. The User (Buyer) is bound by the general terms and conditions applicable at the moment of the purchase (submission of an online order). At every submission of an order, the User (Buyer) shall be specifically notified about the general terms and conditions, and will need to confirm their familiarity with the terms and conditions.


USERS

After the registration in the online shop, www.vitli-krpan.com/en/fan-shop has been confirmed, the User shall be granted the right to purchase items in the online shop, www.vitli-krpan.com/en/fan-shop

 After registering in the online shop, www.vitli-krpan.com/en/fan-shop, the visitor shall be granted a username (the same as their e-mail) and a password. The username and password unequivocally define and link the member of www.vitli-krpan.com/en/fan-shop with the entered data.

At PIŠEK - Vitli KRPAN d.o.o. and in our online store, www.vitli-krpan.com/en/fan-shop, we respect your privacy and protect your data. We operate in line with the Personal Data Protection Act (ZVOP-1) and the General Data Protection Regulation (GDPR).
Your personal data, its collection, and usage are defined in the Personal Data Protection Policy.


ORDERING - CONCLUDING CONTRACTS REMOTELY

The sale/purchase agreement between the Seller, the online shop, KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop, and the User (Buyer), is considered concluded in the online shop, www.vitli-krpan.com/en/fan-shop, the moment when www.vitli-krpan.com/en/fan-shop submits to the Buyer an electronic message regarding the status of their order (titled: KRPAN - Fan-Shop - Order notification).

As of that moment, all prices and other terms and conditions are fixed, and apply to www.vitli-krpan.com/en/fan-shop and to the Buyer. The Buyer is the person with the data that was provided during the submission of the order. Subsequent editing of the Buyer data is not possible. Sale/purchase agreements are concluded in the Slovenian language.

The sale/purchase agreement (i.e. the electronic message containing the order status) is stored in electronic form on the server of www.vitli-krpan.com/en/fan-shop.


ACCESSIBILITY, CONTRACT VALIDITY, and PRICES

The online shop, KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop undertakes to provide the following information to the Buyer prior to the binding of the offer:

  1. company information of www.vitli-krpan.com/en/fan-shop (company name and address, registration number)
  2. contact information that allows the User quick and efficient communication (e-mail, phone)
  3. essential features of the items and the date of validity of the information
  4. accessibility of the items (each item offered on the website should be delivered within a reasonable time period)
  5. delivery terms and conditions (and the delivery method, place, and deadline)
  6. prices which need to be clearly and unambiguously determined, with a note whether they already include taxes and transport costs and other duties, as well as the validity period of the information provided
  7. the payment and delivery or fulfilment method, and the validity period of the information provided
  8. validity period of the offer
  9. the period within which the Buyer may withdraw from the contract, and the terms and conditions thereof (the description of the right to withdraw in line with Article 43 of ZVPot; if the consumer does not have the right to withdraw in line with Art. 43 of ZVPot, then the consumer needs to be specifically notified)
  10. clarification of the complaint process, including all the information of the contact person or contact point.

The online shop, KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop, as the service provider, does not guarantee the correctness or completeness of the information on the website, nor does it guarantee the correctness and completeness of the text or photographic materials. The photographs and the actual appearance of the product may differ.


PRICES

Price
Price is the price under which each item is being sold. All prices in the online shop are in euros and include VAT (Value Added Tax). Prices listed on the website do not include postal charges. The prices are valid as of the moment of the order submission and have no pre-determined validity, except when there is a sale where the validity of the offer is specifically marked. Prices also apply in the event of payments made on the basis of the above payment methods and terms and conditions.

We at KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop, strive to make the information listed on the website as accurate and up-to-date as possible. However, the properties of items, delivery dates, and prices are changing constantly, which is why we may not always correct the information on the website at the moment of the change. In such an event, we notify the Buyer of the change and allow the cancellation or replacement of the ordered product.

Discounts, promotional codes, etc., may not be combined.


THE RIGHT TO WITHDRAW FROM THE CONTRACT, RETURN OF GOODS/REIMBURSEMENT OF THE PAYMENT AND EXCHANGE OF GOODS

The consumer’s right to withdraw from the contract

The consumer (Buyer) (applies exclusively to natural persons who receive an item for purposes not related to their gainful activity) has the right to communicate to the Seller, within 14 days from receiving  the items, that they are withdrawing from the contract, without having to provide a reason for their decision. The deadline begins on the day following the receipt of the items.

The consumer (Buyer) must communicate their intent to withdraw from the contract to the e-mail of the Seller: fan-shop@vitli-krpan.com.

The withdrawal form is available to users here.

In the event of a withdrawal from the contract, the consumer (Buyer) must return the purchased items or send them via post to: PIŠEK - Vitli KRPAN d.o.o., Jazbina 9a, 3240 Šmarje pri Jelšah.

If items are returned to the company within the withdrawal period, then this shall be construed as a withdrawal from the contract.

The consumer (Buyer) must return the item to the Seller undamaged and in the purchased quantity, unless the item is destroyed, defective, lost, or its quantity has been reduced through no fault of the consumer (Buyer). The consumer (Buyer) must not use the items unrestrictedly until the withdrawal of the contract. The consumer (Buyer) may inspect and try out the items in the scope as is necessary to determine their actual state. The consumer (Buyer) is responsible for the depreciation in the value of the goods if the depreciation occurred due to actions that were not necessary to determine the nature, characteristics, and operation of the goods.

The only cost that the consumer (Buyer) must pay regarding the withdrawal from the contract is the cost of returning the items (which is charged as per the pricelist of the courier service, and depends on whether it is a shipment/package/cargo). The item needs to be returned to the Seller within 30 days following the submitted message on the withdrawal from the contract (purchase).

When an item was delivered to the home at a contract that was concluded outside the business premises, the Seller shall collect such an item at its own expense, if the item could not have been returned in the usual way due to its nature.

The consumer (Buyer) does not have the right to withdraw from contracts related to an item that was made as per the exact instructions of the consumer (Buyer) and adjusted to their personal needs.

Reimbursement of payments will be made as soon as possible, but no later than within 14 days following the receipt of the message on the withdrawal from the contract. The company shall reimburse the consumer (Buyer) all payments via the same payment method that was used by the consumer (the most common payment method is payment by bank transfer), unless the consumer (Buyer) specifically requests another payment method and if the consumer (Buyer) shall not incur any costs as a result. Cash refunds are not possible!

When withdrawing from a contract where a bonus, discount code, or promotional code has been used, such assets shall be considered as a discount and will not be reimbursed to the user. The consumer (Buyer) may only be refunded the amount that was paid. Gift cards are considered as a payment method when withdrawing from the contract, and are given back to the consumer (Buyer) as gift cards, while the amount that was paid is returned to the consumer (Buyer).

The right to reimbursement, warranties, quality defects, and incorrectly performed services are all governed in detail by the provisions of the Consumer Protection Act (unofficial consolidated text).

Exchange of goods

The consumer (Buyer) has the right to communicate to the company in writing within 14 days following the receipt of the package and via the attached form for the exchange of goods, that the goods are not to their liking and that they wish to exchange them for other goods. The form can be submitted via e-mail to fan-shop@vitli-krpan.com or to the address of the company. The consumer (Buyer) must then return the goods to the company within 30 days following the written message, whereby the consumer shall cover any direct costs of the return of the goods. The products must not be worn or damaged, and they must be in their original packaging. A copy of the invoice must be attached. The costs of the return of the goods shall be covered by the consumer (Buyer). The costs of sending the new goods shall be covered by the Seller www.vitli-krpan.com/en/fan-shop. If the Seller cannot deliver the exchanged goods within 15 days following the receipt of the unsuitable goods, then the Seller shall make a full refund.

The return/exchange process

  • The returned goods must be accompanied by the Form for the withdrawal from the contract, and a copy of the invoice
  • The address for returning the goods is: PIŠEK - Vitli KRPAN d.o.o., Jazbina 9a, 3240 Šmarje pri Jelšah;
  • We recommend that you use a courier service that offers the tracking of packages. Goods must be properly prepared for transport in order for the goods to arrive undamaged.
  • The sending costs are always covered by the sender.
  • We do not accept cash on delivery packages.

QUALITY DEFECT

What is a quality defect? When:

  • the item does not have the properties that are required for its normal usage or trade
  • the item does not have the properties that are required for the special use for which the Buyer purchased the item, and was known, or should have been known, to the Seller
  • the item does not have the properties and qualities that were explicitly or silently agreed or prescribed
  • the Seller handed over an item that does not match the sample or model, unless the sample or model was shown only as a notice

How to determine the suitability of an item?
The suitability of an item for its normal usage is checked with another flawless item of the same type, as well as with the statements of the producer or statements on the item itself.

How to report a quality defect?
The Buyer must inform us of a possible quality defect and provide an exact description thereof within the legally prescribed deadline, while also allowing us to inspect the item. The form for reporting a quality defect can be found here.

The right to claim a quality defect on an item is governed in detail by the provisions of the Consumer Protection Act.


PAYMENT METHODS

The online shop, KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop allows the following payment methods: 

1. Pro forma invoice: By transferring money to the account indicated on the offer/pro forma invoice*

2. Credit card (MasterCard® and Visa)*

* After payment is received via the offer/pro forma invoice, the order is then moved forward to the processing stage.


DELIVERY

Delivery means and costs, and order processing

Delivery is free* for all orders exceeding EUR 120.00, except for special deliveries. Packages for the company PIŠEK – Vitli KRPAN d.o.o. are delivered by Global Express in the EU area.

Delivery period

Goods in stock will be sent to your address within 3-8 business days; goods not in stock will usually be sent within 8-15 days.

Delivery periods

We will notify you of longer delivery periods via e-mail. If the longer delivery period does not suit you, then you may write to us and we will remove the item from the order or replace it with another.


ORDERING

How can I order products in the online shop, KRPAN Fan-Shop,
www.vitli-krpan.com/en/fan-shop?

You must first add the products from our store to the shopping cart and then continue to register. You may search for products by their categories, which are listed in the upper row. Use filters for easier sorting, also located above.

All products that are shown are in stock and ready for delivery. When you find a product that suits your needs, click the button “Add to Cart”. You may add multiple products into the shopping cart and also remove them easily.

1. Step: Editing the shopping cart

In this step, you can remove items from the cart that you do not wish to order by clicking on “X”. You can also change the quantity of the desired products in the box “QUANTITY -/+”. When the shopping cart has been sorted, you may continue with the order by clicking on “TO REGISTER” in the lower right part of the shopping cart screen.

2. Step: Entering delivery information and choosing the payment method

If you have not logged in to the online store yet, the website will redirect you to the Login page. Here, you can choose “LOGIN”(if you have already registered yourself as a Buyer with your e-mail address and password; if you have forgotten your password, click on “Did you forget your password”). If you are a new user, you may register as a new user - click on “CREATE NEW ACCOUNT”. You can register by filling out all the sections marked with an asterisk in “Address for invoice”. Enter the information required for the invoice and delivery. When you sign in, choose “Delivery method” and then “Payment method”. When you have chosen everything, click the button “ORDER OVERVIEW” in the lower right part of the shopping cart screen.

3. Step: Overview and confirmation of the order and payment

Here, you can re-check the ordered items, information required for the invoice, delivery information, the payment method, and the delivery method. The website will warn you again: “The order has not been submitted yet. Please re-check all of the information provided, then click on Submit order to submit your order.” If all the information is correct, click the button “SUBMIT ORDER” in the lower right part of the shopping cart screen. 

4. Step: Conclusion of the order

You have successfully submitted your order. The website displays the following message:
“The order has been successfully completed. You will receive the order confirmation e-mail shortly. Please pay the full amount to the following bank account: SI56 0510 0801 4236 488 (Nova KBM d.d. - Abanka, d.d., BIC:ABANSI2X). Please provide the following order reference: #. Company information: PIŠEK - Vitli KRPAN, d.o.o., Jazbina 9a, 3320 Šmarje pri Jelšah, Slovenia."


COMPLAINTS AND DISPUTES

The online shop, KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop must confirm to the user, within five days, that they have received the complaint, and communicate the duration of the complaint handling process. They must also provide regular updates to the user regarding the process.

The online shop, KRPAN Fan-Shop, www.vitli-krpan.com/en/fan-shop shall use its best endeavours to resolve any possible disputes in a mutual manner, otherwise the resolution will be made by the competent court in Celje.

Out-of-court resolution of consumer disputes

In line with the legal norms, the company PIŠEK - Vitli KRPAN d.o.o. does not recognise any out-of-court contractors for resolving consumer disputes as competent for resolving any consumer disputes of the consumer in line with the Out-of-Court Settlement of Consumer Disputes Act.

The company PIŠEK – Vitli KRPAN, d.o.o., which is the provider of goods and services via its online store on the territory of RS, provides an electronic link on its website to the platform for resolving consumer disputes (SRPS). The platform is available to consumers here.

The order comes from the Out-of-Court Settlement of Consumer Disputes Act, the Regulation (EU) 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes, and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC.
